1 Purpose of Policy
- 1. Section 17 of the University of Wollongong Act 1989 states that “the Council may, in relation to any matter or class of matters, or in relation to any activity or function of the University, by resolution, delegate all or any of its functions (except this power of delegation) to any member or committee of Council or to any authority or officer of the University or to any other person or body prescribed by the By-laws”.
- 2. This policy provides the delegations of authority relating to the following matters at the University of Wollongong:
- a. Financial Delegations
- b. Employment Delegations
- c. Contract and Agreement Delegations
- d. Academic Delegations
- e. IT Delegations
- f. Miscellaneous Delegations
2 Definitions

3 Application and Scope
- 1. The policy applies to staff and committees of the University of Wollongong as specified in the delegations of authority.
- 2. Nothing in the delegations of authority has the effect of invalidating past acts validly performed by delegates under previous delegations.
4 General Principles of Delegation
- 1. Delegations are conferred on a position and thus to the incumbent of the position at that time. Where a delegation is to a committee, the delegation refers to the committee acting as a whole not to individual members of that committee.
- 2. If a position or committee is abolished or re-named, the delegation should be taken to be a reference to the principal successor to the functions of that position or committee. Such minor amendments can be made to this policy without further recourse to Council.
- 3. A delegate must not exercise a delegation if it involves a contravention of the Conflict of Interest Policy.
- 4. No delegate is authorised to sub-delegate any or all of the delegate’s delegated functions to another person or group of persons.
- 5. All delegations must be read subject to, and exercised in accordance with the relevant:
- a. Legislation: In particular, the University of Wollongong Act 1989 (NSW) and delegated legislation (the University of Wollongong By-Law 2005 and University Rules) and other relevant legislation (e.g. Higher Education Support Act 2003 (Commonwealth), Workplace Relations Act 1996 (Commonwealth));
- b. Industrial awards and agreements;
- c. University policies, codes of conduct, duly established procedures or guidelines; and
- d. Resolutions of the University Council.
5 Reporting Requirements
- 1. The exercise of certain delegations must be reported to the next meeting of the University Council:
- a. acting on behalf of Council on urgent matters between Council meetings (Administrative Committee);
- b. use of the Seal;
- c. conferral of awards by the Chancellor outside of the Council meeting or graduation ceremony;
- d. approval of major expenditure projects (over $3,000,000 million) by position or committee;
- e. appointment of professors/ senior officers;
- f. any other matter as specified in resolutions of the Council from time to time.
6 Retained Authority
- 1. The University Council retains the authority to determine certain matters including the following:
- a. power of delegation;
- b. appoint the Vice-Chancellor and Chancellor of the University;
- c. establish or disestablish positions of Deputy Vice-Chancellor, Pro Vice-Chancellor, Vice-Principal and University Librarian;
- d. confer and rescind degrees, diplomas, certificates and other awards;
- e. approve overall University Budget;
- f. award Honorary Doctorates, University Fellowships, Emeritus Professorships and the Chancellor Robert Hope Memorial Prize;
- g. approve University Rules;
- h. approve the University Capital Management Plan;
- i. approve the University Strategic Plan;
- j. approve incorporations or the creation of new wholly owned University companies, or the winding up of such companies; and
- k. approve commercial activities in accordance with Commercial Activity Guidelines – in excess of $4,000,000.
7 Operation of Delegations
- 1. Some delegations in this policy are granted to groups of positions (Delegation bands). There are four delegations bands referred to in this policy which reflect different levels of responsibility: Bands A, B, C and D. A list of the positions that comprise each delegation band is provided at Appendix 1.
- 2. Where delegations are made in accordance with a specific policy or with regard to particular legislation, or when the exercise of a delegation requires completing a particular form, the relevant documents are listed alongside the delegation.
8 Financial Delegations
- 1. The exercise of all financial delegations is closely related to the policies and procedures on each issue. Delegations may only be exercised within the framework of these policies. Advice is available from the Financial Services Division.
- 2. Delegates must not approve the incurring or the reimbursement of their own expenditure, even if it falls within their responsibility levels (refer the Segregation of Duties Policy). Such expenditure must be approved by another appropriately delegated officer.
- 3. Any delegation to incur expenditure must be exercised within the limits of the relevant budget or other approved source of funds.
- 4. Authorities delegated to committees are detailed in the respective committees' terms of reference and/or in policies specified alongside the delegation.

10 Academic Delegations
- 1. The exercise of all Academic delegations is closely related to the Rules, policies and procedures on each issue. Delegations may only be exercised within the framework of these policies. Advice is available from the Academic Registrar’s Division.
- 2. Authorities delegated to committees are detailed in the respective committees' terms of reference and/or in policies specified alongside the delegation.
- 3. Where two or more officers are listed eg Sub-Dean/Head of Unit this indicates either may approve depending on local arrangements in the Faculty.
- 4. All waivers of general course rules or degree rules are considered by the Dean of Students or Deputy Vice-Chancellor (Academic).
