Circuit Layout RightsCircuit layout rights, sometimes referred to as computer chip or semi-conductor chip designs, protect the layout designs, topographies or plans of integrated circuits used in computer-generated equipment. The right is granted to the layout and not the circuit itself. The holder of the right is able to:
- make an integrated circuit from the layout design;
- copy the layout in material form; and
- commercially exploit the layout in Australia.
Circuit layout rights are similar to copyright, in that the rights are automatically granted upon creation and do not require registration. Others can use the layout for the purposes of:
- private use;
- research or teaching purposes; or
- evaluation of the layout.
The Circuit Layouts Act 1989 provides for circuit layout rights. Protection can be provided for up to 20 years from date of creation.
