Managing human rights and covert methods in transnational criminal investigations

Abstract:

As Australia ponders a) whether to adopt a human rights framework and b) reviews its mutual legal assistance (MLA) framework and considers whether to provide covert investigation assistance in response to MLA requests, this paper reflects upon issues raised for investigators operating within a human rights-based jurisdiction when they need to collaborate with investigators whose own jurisdiction does not offer the same protections.

Short Biography:

Dr Clive Harfield joined the Faculty of Law in August 2008 from the UK where he had previously been a Reader in Policing at London Metropolitan University and a police officer with operational experience in three local forces and two national agencies. He teaches criminal law at University of Wollongong and his research interests include MLA (mutual legal assistance) and covert investigation.
