INTERNATIONAL INFLUENCES

Here we have collected references to writings relevant to the global influences currently operating on courts around the world.

National courts cannot remain untouched by the influences of the global economy or the international institutional and political environment. This is particularly so in the developing world, but even in the advanced economies there are convergent influences. National policy makers and planners are looking to the experiences and systems of other countries to inform their own reforms.

Reflecting this international environment this section begins with references which discuss the global economy. It continues with discussions of justice system reform in both theory and practice.

Globalisation - international politics - World Bank - justice system reform

Professor Boaventura de Sousa Santos focuses on globalisation in it many forms and its many impacts on national and subnational societies, cultures and politics. A distinction between hegemonic and counter-hegemonic forms of globalisation is established, and four modes of production of globalisation are analysed: globalisaed localism, localised globalism, cosmopolitanism and common heritage of mankind. Special critical attention is given to the globalisation of the legal field and the Western model of democracy. The case studies are drawn from the Americas, Africa, Asia and Europe.
